The most significant deficiency is the explicit exclusion of aquaculture space allocation (Clause 1.3), which directly undermines TKKL's strategic objective of integrating fisheries and aquaculture management.
Recent Hauraki settlements (Ngāti Rāhiri Tūmutumu, September 2025; Ngāti Pāoa, 2025 Act) establish a new baseline that includes full multi-portfolio scope, living document status, mandatory joint work programmes, and simplified dispute resolution.
The negotiation team must not accept the current template. The Crown cannot claim that stronger provisions are "beyond policy" when they have already been signed into law for other iwi within the last 12 to 24 months.
